Court: Wire-tap -OK

It looks the "illegal wire-tap plea" (i.e. NSA Surveillance) just might not be working for the ACLU (and will not enable them to free some of our convicted and confessed terrorist affiliates!)...

Prosecutors say Abu Ali conviction untainted by wiretap issues

ALEXANDRIA, Va. Prosecutors say they have NO reason to believe that the conviction of a Virginia man who joined al-Qaeda and plotted to assassinate President Bush was tainted by the government's post Nine-Eleven eavesdropping program.

Lawyers for Ahmed Omar Abu Ali (AHK'-med OH'-mar ah-BOO' ah-LEE') asked a federal judge last week to delay their client's sentencing hearing on Friday. He faces a mandatory minimum of 20 years in prison when sentenced. Prosecutors are asking the judge to impose a life sentence.

Lawyers for the 24-year-old Falls Church man asked to allow an investigation into whether Abu Ali was a subject of the National Security Agency's warrantless eavesdropping.

Prosecutors today opposed any delay, saying Abu Ali's lawyers have NO evidence to suggest their client was wronged.

Again: The filing is the first substantive response by prosecutors to accusations made in several cases by defendants who suspect their clients were subject to the surveillance program, secretly initiated shortly after the terrorist attacks.
